Contract review: developer and reservation agreements

Before you sign a reservation agreement (umowa rezerwacyjna) or a developer agreement (umowa deweloperska), show it to us. We check the terms and point out the risks – including deadlines, the payment schedule, contractual penalties and withdrawal terms – so you know what you are signing and can ask the developer the right questions.

How we work

  1. Send us the documents Pass us the draft reservation or developer agreement and, if you have it, the developer's information prospectus (prospekt informacyjny).
  2. Review of the terms We check, among other things, the subject of the agreement and the price, the payment schedule, the escrow account (rachunek powierniczy), the deadlines for completing construction and transferring ownership, contractual penalties and withdrawal terms.
  3. Discussion of the risks We point out the clauses worth paying attention to and the questions worth asking the developer.
  4. Your decision You sign the agreement with your eyes open – knowing its terms and the possible risks.

Frequently asked questions

What is the difference between a reservation agreement and a developer agreement?

A reservation agreement is a preliminary step – the developer undertakes not to sell the chosen apartment to anyone else for a set period. A developer agreement is signed as a notarial deed (akt notarialny) and obliges the developer to build the apartment and transfer its ownership to the buyer.

What should I check in a developer agreement?

Among other things: the description of the apartment and its finish standard, the price and payment schedule, the type of escrow account, the deadlines for completing construction and transferring ownership, contractual penalties and the conditions for withdrawing from the agreement.

What is an information prospectus?

It is a document the developer gives the buyer before the agreement is signed. It contains information about the developer, the development and the apartment – it is worth comparing it with the terms of the agreement.

How much does a contract check cost?

We agree the terms individually. Leave your details or give us a call – we will give you the details.

Does a contract check replace a lawyer's opinion?

Our comments help you understand the agreement and identify risks. If the matter requires a legal opinion, we will recommend consulting a Polish lawyer (radca prawny or adwokat).
